License agreements are increasingly being affected by new regulations and changing laws. Legal frameworks such as the EU Cyber Resilience Act, the EU AI Act, and the EU Data Act are shifting security, update, and liability obligations between parties and raising new questions about data access, usage rights, and interfaces. They are forcing licensees and licensors to discuss the distribution of tasks relating to data quality, transparency, monitoring, and product liability. New and unexpected developments in US patent law are influencing the scope of protection, enforceability, and valuation approaches in cross-border licensing models. When it comes to technology transfer from universities to industry, freedom of publication, field and exclusive rights, and commercialization pressure all come into play.
